Topps has won a legal battle with former Apollo astronaut Buzz Aldrin.
In a suit we reported on last year, Aldrin and his licensing arm, StarBuzz LLC, filed suit in federal court, claiming Topps unjustly profited from his inclusion in the 2009 American Heroes set.
Topps claimed the historical images were protected under fair use statutes and U.S. District Judge Dean Pregerson agreed, stating that photos on the cards depicting the Apollo 11 mission were protected as “free speech of an issue of public interest.”
The case isn’t entirely over, though. Aldrin has taken his claims to the U.S. 9th Circuit Court of Appeals.
