Did eBay infringe on a patent for its popular ‘Buy it Now’ feature? A small company says ‘yes’ and they’ve asked a court to stop it.
For eight years a two-man computer company has been attempting to tell the world eBay stole their patent for the feature that allows bidders to meet a ‘selling price’ and buy an item outright.
MercExchange LLC filed a motion for an injunction against eBay that, if granted, will bar it from continuing to include the "Buy It Now" function on its site. About 1/3 of eBay’s sales come from matching buyer to seller at a fixed price, a program the company’s lawyer claims is worth a ton of money.
