Waltrip Lawyers Threaten Shop Owner

Darrell Waltrip's attorneys are pretty sure he invented the word "Boogity".

The owner of a small Canadian racing memorabilia shop has changed the name of the place to placate angry attorneys representing NASCAR broadcaster Darrell Waltrip.

Thus, Boogity Boogity Racing/Boogity Sportswear is now R&B Embroidery.

In a scene straight out of Talladega Nights, a firm representing the intellectual property of Waltrip sent a letter to Randy Nicholson telling him the name was violating Waltrip's trademark phrase uttered at the start of each race: "Boogity, Boogity, Boogity, Let's Go Racin'!" screams the former Daytona 500 winner in the TV booth.

Nicholson says he named his business long before the 2005 date when Waltrip trademarked the phrase in Canada. While the fact that "boogity, boogity" is trademarked in Canada might be worth a story in itself, we'll stick to the issue at hand.

According to this story in the Telegraph-Journal of New Brunswick, Nicholson has decided not to fight the deep pocketed Waltrip empire.
